Issue: Balcony condensation

A number of residents at South Gardens have reported issues regarding condensation dripping from above inset balconies.

It is important to report the issue now, as the NHBC warranty is only valid for up to ten years which many buildings in the estate are getting close to. To ensure appropriate remediation, we recommend you report any issues you have as soon as possible.

Savills has issued guidance on how to report the issue with NHBC, the new build warranty provider:

“We are writing to inform you that we are aware of reports from some residents regarding condensation dripping affecting their inset balconies.

Please find attached the NHBC claims process and claims statement for your reference, should you need to utilize them. It is important that any relevant issues are reported directly to the NHBC to ensure appropriate remediation where necessary.

This may be particularly pertinent for those who have recently experienced issues with their balconies. While we understand that the balconies are not owned by the residents (similar to other parts of the building structure), an NHBC resolution may be required if the leaseholder feels that the developer has not adequately addressed the issue. In this instance, the developer is also the Freeholder, and the NHBC can assist with a resolution, whether or not the issue falls within the leaseholder’s demise.

Please note that part of the NHBC application process requires the Buildmark policy number, which is unique to each leaseholder. As a result, any issues must be reported on an individual basis.

It is important to clarify that ownership of the part of the building in question does not matter when raising concerns. The primary focus is to identify any required works, determine liability, and establish the most effective course of action. If a structural defect is found in more than one area of the building, the NHBC will incorporate this into their findings. For example, in the event of a significant structural issue, such as a roof failure, we would take charge of the situation accordingly.

While Savills is not responsible for managing or rectifying any build or structural defects, we are committed to guiding residents through the NHBC process. Please note that it is the leaseholder’s responsibility to initiate any enquiries with the NHBC. During this process, NHBC may request survey reports from Savills, which we will provide as needed.
